Project Components

  • A Freelance Design Contract is an agreement between Designer and Client to fulfill a design project.
  • An agreement must be made regarding specific services the Designer shall provide and the time of completion.
  • If the project requirements change drastically after work begins a new contract may be required.

Description of Project

  • Description of specific services being provided.
  • Specifications of completed project to be delivered.
  • Date of completion.
    1. Include production stages (dates for completion of drafts/sketches etc.).
    2. Outline liability in the event that a schedule must be changed.
    3. List any other events that may affect delivery

Associated Costs

  • Prior to presenting a Client with a Design contract they must approve a detailed estimate of costs.
  • After Client approval, the Designer will present them with the contract to sign.
  • Include in the contract a price breakdown of labour, materials and other costs.
  • Include terms of payment. There are a variety of payment options to choose from.
    1. Cash/Cheque/CreditCard.
    2. Initial deposit and payment schedule
    3. Upon Delivery/within 30 days of invoice
    4. ETC.
  • Include in the contract a cancellation fee. This will ensure that the Designer will receive compensation for work done even if the Client cancels the project.
  • A clause for additional expenses may be included in the contract. These expenses may include alterations or revisions by the Client.

Ownership of Artwork and Designs

  • While the finnished product will be delivered to Client, the Designer often retains the original files. If the Designer turns over the originals there may be an additional charge.
  • In the case that the Designer does retain ownership of original designs the contract may include the return of all designs and additional fees should the Client cancel the project
  • Designers may choose to include in the contract the right to use designs and samples of the project in their portfolio, design competitions and for other uses.
